In new-build projects, the contractual warranty regime, acceptance procedure and builder guarantees may be more important than general statutory concepts.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Legal Guarantee &#8211; statutory, but limited<br><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory <strong>Legal Guarantee (Gew\u00e4hrleistung)<\/strong> obliges the seller to be responsible for material defects that already existed at the time of handover &#8211; regardless of whether the buyer uses the yacht privately or commercially.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Key points:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For private use: Warranty period for new yachts generally 2 years; may be reduced to 1 year for second-hand purchases.<\/li>\n\n\n\n<li>For commercial use (B2B): Warranty can be excluded or limited extensively by contract &#8211; stricter standards and less buyer protection often apply here.<\/li>\n\n\n\n<li>Within the first 12 months, a reversal of the burden of proof applies in Germany: the seller must prove that the defect did not exist at the time of delivery.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u26a0\ufe0f In the case of commercially used yachts (e.g. in the charter fleet), extended inspection obligations and less protection against defects are often assumed. Professional contract drafting is particularly critical here.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Commercial Warranty (Garantie) &#8211; voluntary, but often misunderstood<br><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>Commercial Warranty<\/strong> is not a legal obligation, but a voluntary promise, usually given by the manufacturer. It can &#8211; e.g. for engines, electronics or hulls &#8211; include services that go beyond the warranty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Important for buyers:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Commercial Warranty conditions are individual and often limited &#8211; e.g. to certain components or excluded for commercial use.<\/li>\n\n\n\n<li>In practice, guarantees are often confused with warranties &#8211; in the event of damage, this can lead to the loss of claims.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Typical pitfalls when buying a yacht<br><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Standard contracts without protective effect &#8211; e.g. for used boats abroad.<\/li>\n\n\n\n<li>Legal Guarantee excluded in B2B contracts &#8211; especially with charter companies.<\/li>\n\n\n\n<li>Insufficient documentation &#8211; e.g. handover protocols, inspections, maintenance history.<\/li>\n\n\n\n<li>Commercial Warranty expiry due to unauthorised use &#8211; e.g. commercial use with private registration.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Our legal service<br><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A warranty is only as valuable as the party standing behind it and the procedure for enforcing it.
